5.1 Product Nature and Signs of Authenticity

The Customer acknowledges that Bird Box Records products are the result of analog and artisanal processes. Minor physical variations or aesthetic imperfections are not to be considered manufacturing defects, but rather distinctive signs of authenticity and manual craftsmanship. Our pursuit of "sonic truth" may include ambient sounds or characteristics inherent to the original tape, which are an integral part of the artistic and historical value of the work.

5.2 Compatibility and Customer Hardware

Our productions feature high dynamic range and superior technical standards. Bird Box Records shall not be held liable for damage to the Customer’s hardware components (styli, cartridges, playback systems, tape heads) resulting from the use of equipment that is improperly calibrated, worn out, or unsuitable for the reproduction of high-fidelity audiophile media.

5.3 Conservation Protocol and Magnetic Integrity

Given the extreme sensitivity of Master Reels (Magnetic Tapes) and vinyl records, the Company disclaims any liability for damage resulting from improper storage. Media must be kept away from:

• Heat sources and direct sunlight.

• Electromagnetic fields (loudspeakers, transformers, screens).

• Excessive humidity or dust. We are not responsible for accidental demagnetization or physical deterioration occurring after delivery and acceptance of the product.

5.4 Listening Experience and Subjective Taste

Bird Box Records captures the acoustic reality of the moment without digital corrective manipulation. Extreme fidelity to the original source may differ from commercial listening standards; therefore, we do not accept claims or returns based on the Customer's subjective taste or lack of alignment with personal aesthetic expectations.

5.5 Intellectual Property and Reserved Rights

All content on this portal (text, logos, photographs, audio masters) is the exclusive property of Bird Box Records S.r.l.s. or its respective licensors. Unauthorized reproduction, duplication, sampling, or distribution of any material, whether physical or digital, is strictly prohibited. Any violation will be prosecuted under international copyright laws.

6. APPLICABLE LAW AND JURISDICTION

6.1 Law and Jurisdiction

This website is operated and controlled by Bird Box Records S.r.l.s. in Italy. These Terms and Conditions, the Privacy Policy, and all matters related to your orders or the use of the site are governed exclusively by Italian Law. The Customer agrees to submit to Italian jurisdiction for any disputes arising from the use of our website, our services, or orders placed.

6.2 Exclusive Forum of Jurisdiction

For any dispute regarding the interpretation, execution, or termination of the contract and the use of Bird Box Records services, the parties recognize the Court of Rome as the sole and exclusive forum.

Note: If the Customer acts as a "Consumer" under the Italian Consumer Code (D.Lgs. 206/2005), the mandatory territorial jurisdiction will be that of the court in the place of residence or domicile of the consumer, if located within the Italian State.

6.3 Online Dispute Resolution (ODR)

In compliance with EU Regulation No. 524/2013, we inform Customers residing in the European Union that the European Commission has established an online platform for alternative dispute resolution. This tool can be used by European consumers to resolve out-of-court any dispute relating to sales contracts for goods and services entered into online.
